Hero Adventure

Terms of service

Version 3. Applies to new orders placed after publication of this version. Previously placed orders retain their agreed terms.

These terms explain how you can use Hero Adventure at hero.vassistant.app. They cover the website and its free demos, the online brief, and ordering a personalised adventure. You can read, download and print them at any time from /terms. Before you pay, we ask you to accept them, and we send them to you with the order confirmation.

1. Who we are

Hero Adventure is run by Rafał Kondrat, trading as Rafał Kondrat Thirty-A, ul. Majowa 16, 41-706 Ruda Śląska, Poland, registered in CEIDG (the Polish business register), NIP 6561990629, REGON 260077120 ("we", "us").

The same e-mail address is our single point of contact for users and for public authorities under the EU Digital Services Act.

2. Words we use

3. What we offer

We make every Adventure with our team, using generative AI for the illustrations (section 10). The descriptions and prices on the website are an invitation to order. The contract is formed as described in section 7.

4. What you need

Using the free services is a contract that costs nothing. It begins when you start using them, and you can end it at any time by leaving the site, or for a brief by deleting it.

5. Rules for everyone

You must not:

We review every brief by hand. We may decline a brief, remove material or stop an Adventure that breaks these rules, the law, or the usage rules of our AI service. If we do, we tell you which content is affected and why, and you can ask us to reconsider at rafal.kondrat@gmail.com. If you paid for an order we decline before delivery, we refund it in full.

6. The brief

7. Ordering and paying

  1. You choose what to order on the website. Before you pay, we show the total price in Polish złoty (PLN) and the delivery time. All prices include VAT. There are no extra fees.
  2. You pay through Stripe using the methods shown at checkout. Card payment is currently available. Stripe processes the payment; we never see your full card details.
  3. Directly before you order, we show you what you are buying, the total price and how long the Adventure stays available. You order by clicking the button "Order with obligation to pay". The contract is formed when your payment is completed. We then send you a confirmation by e-mail, a durable medium, before paid production starts. It contains your order, these terms, the privacy policy and the choices you made at checkout (section 12).
  4. We issue an invoice or receipt as the law requires. If you need an invoice for a company, enter its details at checkout.
  5. When we announce a price reduction, we also show the lowest price that applied in the 30 days before it.

8. How we make your Adventure

  1. Review. We check the brief and the photos. If something is missing, we ask you for it.
  2. Free portrait preview. AI generates the first portrait from your photos. A person reviews it and fixes obvious defects. The preview and one additional version based on your feedback are free. If you request the revision, we show both versions side by side at the same size. Defect fixes do not use your revision. Pay only after explicitly approving your chosen portrait. If neither suits you, leave without paying. The preview is not supply under the paid contract and does not affect your withdrawal rights for that contract. We email you when the reviewed portrait is ready; the paid production deadline does not cover the wait for a free preview.
  3. Production and delivery. Animation production requires both portrait approval and successful payment. We usually deliver the game within 24 hours of payment, with up to 7 calendar days during busy periods. If you do not choose early production (section 12), this window starts on the permitted production start date. Free preview preparation and review time are not counted in the paid production window. If we request specific information needed to proceed after payment, only the actual waiting time extends the deadline. We record the dates and confirm the revised deadline by email. Our work and defect corrections do not extend the deadline. Tell us before payment if you need an essential delivery date. Changes to an expressly agreed essential date require your agreement. If we miss that date without agreement, you can withdraw and receive a full refund.
  4. Corrections. After delivery you can ask for one free round of text corrections within 30 days. Faults are always fixed for free (section 13).
  5. Delays. If we cannot deliver on time, we tell you straight away and agree a new date with you. If we still do not deliver, consumers may withdraw from the contract under the law, and we refund the price.

9. Delivery and access

10. Artificial intelligence

11. Your rights to the Adventure

12. Withdrawal from the contract (consumers)

  1. As a consumer, you can normally withdraw from a contract made online within 14 days of making it, without giving a reason.
  2. Early production is optional. At payment you may select one optional, initially unchecked box requesting production and consenting to game delivery before the 14 days end. You acknowledge the loss of your statutory right to withdraw for digital content when supply of the paid game begins, and for the service once it is fully performed. Without this choice we start on the day after the withdrawal period ends. If the last day falls on a Saturday or Polish public holiday, the period ends on the next working day. Before production, we email your recorded choice, order confirmation, terms and privacy policy.
  3. The preview and the paid order. The free portrait, its revision and their approval do not remove your right to withdraw from the paid contract. The withdrawal period starts when the paid contract is formed, on successful payment. If you expressly requested an early start to the paid service and withdraw before completion, any amount owed for work performed is calculated proportionately under the law; the free preview is not charged. Loss of withdrawal rights for paid digital content requires the statutory conditions, including prior consent, acknowledgement and confirmation on a durable medium. Your rights for faults (section 13) remain unchanged.
  4. How to withdraw. Send us a clear statement by e-mail to rafal.kondrat@gmail.com or by post. You may use the model form in the annex, but you don't have to. We confirm receipt by e-mail.
  5. Refund. We return the payment, less any amount due under point 3, within 14 days of receiving your statement. We use the same payment method unless you agree otherwise. We then delete your brief and photos, unless you ask us to keep the brief.

13. Faults and complaints

  1. We must deliver an Adventure that matches the contract. Examples of faults: it does not open on a device that meets section 4, a chapter or the ending is missing, a name, text or photo is wrong compared with the brief, or an obvious AI error.
  2. Send a complaint to rafal.kondrat@gmail.com with the Link and a description of the problem. Screenshots help. We reply within 14 days. If we do not reply in that time, a consumer's complaint counts as accepted.
  3. If the Adventure has a fault, we fix it for free within a reasonable time. If we cannot or do not fix it, or the fault is serious, a consumer can ask for a price reduction or withdraw from the contract, as the Consumer Rights Act provides.
  4. When you approve the portrait, you expressly accept its look, including the ways an illustrated likeness differs from a photograph. Matters of taste within an approved portrait are therefore not faults. Visible errors always are.
  5. For buyers who are neither consumers nor sole traders with consumer rights, our liability for faults is limited to fixing the Adventure or refunding the price.

14. Settling disputes out of court

If we cannot agree, a consumer can use out-of-court ways of handling complaints and claims:

The register of these bodies is at polubowne.uokik.gov.pl. Using them is voluntary for both sides. We decide case by case whether to take part in such a procedure. If we turn down a complaint, we tell you in writing whether we agree to such a procedure.

15. Reporting illegal content

  1. Anyone can report content on our service that they believe is illegal. For example, an Adventure may use your image without permission. Write to rafal.kondrat@gmail.com and include:

    • why you consider the content illegal;
    • the exact Link or location;
    • your name and e-mail address, except where the report concerns certain sexual offences against children;
    • a statement that you believe in good faith that the report is accurate and complete.
  2. We confirm receipt and decide carefully, objectively and without undue delay. We tell you our decision and how to challenge it.
  3. If we remove or restrict content, we tell the Buyer what we did and why, and how to ask us to reconsider. We do not use automated tools to make these decisions.
  4. If we learn of information giving rise to a suspicion of a criminal offence that threatens someone's life or safety, we inform the authorities.

16. Sole traders with consumer rights

The rules in these terms on withdrawal (section 12), unfair contract terms and the conformity of digital content (section 13) also apply to a sole trader with consumer rights, as Polish law provides.

17. Liability

  1. We are liable as the law provides. Nothing in these terms limits a consumer's statutory rights.
  2. We are not responsible for harm caused by a Link being shared with people the Buyer or Recipient did not intend. Nor are we responsible for material a Buyer sent us in breach of section 5 or 11.
  3. If the service is interrupted by events outside our control, we restore it as soon as we can.
  4. For buyers who are not consumers, our total liability is limited to the price paid, and we are not liable for lost profits. This limit does not apply to harm caused intentionally.

18. Personal data

How we use personal data, including AI processing and the rights of Recipients, is explained in the privacy policy at /privacy.

19. Changes to these terms

We may change these terms for important reasons: a change in the law, new features, security, or a change in our AI or payment providers. We publish the new version at least 14 days before it takes effect and e-mail buyers with orders in progress. An order always follows the version you accepted when you placed it.

20. Final provisions

  1. These terms and contracts made under them are governed by Polish law. If you are a consumer living in another country, you keep the protection of the mandatory consumer-law provisions of that country.
  2. A consumer may bring a claim before the courts that have jurisdiction under the general rules, including the courts where they live. For other buyers, the court for our registered address has jurisdiction.
  3. These terms exist in Polish and English, and the order confirmation includes both. For consumers living in Poland, the Polish version is part of the contract. For consumers who are Polish citizens, the Polish version prevails. In every other case, the version in the language of your order applies.
